Les Musulmans Indiens Pour Une Démocratie Laïque (IMSD) [2] s’opposent vigoureusement à la demande inconstitutionnelle faite par le Bureau Musulman Indien de la Loi sur le Statut Personnel (All India Muslim Personal Law Board -AIMPLB) et quelques autres organisations qui réclament l’adoption d’une loi contre le blasphème en Inde. La déclaration de l’IMSD a été approuvée par presque 400 indiens laïques. Une large majorité des signataires sont des musulmans.
Nous condamnons les perpétuelles tentatives de certaines composantes de l’Hindutva qui travaillent sans relâche à démoniser l’Islam et les musulmans. Cependant, l’IMSD soutient totalement le principe selon lequel, dans une société laïque, il n’y a aucune place pour une loi criminalisant le blasphème.
Les musulmans qui réclament une telle loi devraient plutôt s’appuyer sur la loi existante contre le discours de haine (hate speech) dans notre pays. Selon la Section 295 (A) du Code Pénal indien, « Quiconque, avec l’intention délibérée et malveillante d’outrager les sentiments religieux de quelque catégorie de (citoyens indiens), (par des mots, qu’ils soient dits ou écrits ou par des signes ou par des représentations visibles ou d’autres façons) insulte ou tente d’insulter la religion ou les croyances religieuses de cette catégorie, sera puni d’emprisonnement pour une durée qui peut s’étendre à (trois ans) ou une amende ou les deux ».
En tant que citoyens indiens égaux, les musulmans ont le droit d’invoquer la Section 295 (A) contre toute tentative de cibler la communauté par un discours de haine et d‘exiger la stricte application de la loi existante. Mais l’exigence d’une loi spécifique pour punir le blasphème doit être rejetée pour plus d’une raison.
Entre autres, l’expérience des pays voisins montre que ce genre de lois promeut le fanatisme et a pour but de réduire au silence jusqu’aux commentaires critiques rationnels de la religion.
Le Bureau (AIMPLB) ne saurait ignorer la loi anti blasphème bien connue du Pakistan voisin, qui est fréquemment utilisée à tort pour pourchasser des individus des minorités religieuses - et même d’autres musulmans - pour des motifs sectaires et personnels.
Selon l’Association des Minorités du Pakistan, « entre 1987 et 2021, 1865 personnes ont été accusées sous la loi anti-blasphème, avec un pic significatif en l’an 2000, où 200 cas ont été enregistrés. Le Penjab, la province où vivent la plupart des chrétiens pakistanais, tient la tête avec 76% des cas et 337 personnes en prison pour blasphème… De plus, au moins 128 personnes ont été tuées par des foules, hors de tout processus judiciaire, après avoir été pointées du doigt comme s’étant rendues coupables de blasphème ou d’apostasie, sans avoir la moindre chance d’avoir accès à une enquête, et nul n’a été arrêté pour leur assassinat ».
Le Bangladesh voisin est né pays laïque en 1971, mais a adopté l’Islam comme religion d’état en 1998. Il n’a pas de loi anti-blasphème mais pervertit souvent le même Code Pénal laïque hérité de la domination britannique – section 295 (A) – pour réduire au silence tous les commentaires critiques sur l’Islam en les qualifiant de blasphème.
